Final Emergency Regulations Issued Requiring COVID-19 Vaccination for Health Care Workers

On November 4, 2021, the final regulations regarding the Emergency Rule Requiring COVID-19 Vaccination for health care facilities that participate in the Medicare and Medicaid programs were released.

The regulations require that covered facilities establish a policy ensuring all eligible staff have received the first dose of a two-dose COVID-19 vaccine or a one-dose COVID-19 vaccine by December 5th. All eligible staff must be fully vaccinated by January 4, 2022. The regulation provides for exemptions based on recognized medical conditions or religious beliefs, observances or practices. These requirements are found in a new section to the ASC Conditions for Coverage created by the rule.

COVID-19 Action Plan May Require Vaccinations in Your ASC

Last week, the Biden administration announced a new action plan that initiates a six-pronged national strategy that aims to combat COVID-19 and its variants.

SCASCA wants to ensure that members are aware that the plan requires the vaccination of workers in most healthcare settings that receive Medicare or Medicaid reimbursements, including ASCs. This requirement will affect a majority of healthcare workers, including clinical staff, individuals providing services under arrangements, volunteers, and staff who are not involved in direct patient, resident, or client care.

In a press release issued by the Centers for Medicare & Medicaid Services (CMS), CMS is developing an Interim Final Rule with Comment Period that will be issued in October.

SCASCA will continue to monitor the situation and will keep members informed of further developments.

SCASCA Update: Medicare 2022 Proposed Rule

On July 19, the Centers for Medicare & Medicaid Services (CMS) released the 2022 proposed payment rule for ASCs and hospital outpatient departments (HOPD). This is the first update to ASC Medicare rates under the Biden administration and new CMS Administrator Chiquita Brooks-LaSure. You can read more about it by clicking here.

SCASCA is partnering with ASCA to get your feedback to help shape their comments on the proposed rule! Specifically, ASCA is requesting your input on two provisions in the proposed rule: codes proposed for removal from the ASC Covered Procedures List (ASC-CPL) and proposed mandatory implementation of the Outpatient and Ambulatory Surgery Consumer Assessment of Healthcare Providers and Systems (OAS CAHPS) Survey-based measures (ASC-15a-e) beginning in 2024.
